myVertiflex Privacy Notice

This privacy notice governs your use of the myVertiflex application ("Application") created by Boston Scientific Corporation ("BSC" or "We" or "Us") on a mobile device.

What Information does the Application obtain and how is it used?

User Provided Information —
The Application obtains the information you provide when you download and register the Application. Registration with us is optional. However, please keep in mind that you may not be able to use some of the features offered by the Application unless you register with us.

When you register with us and use the Application, we obtain: (a) your name (b) your pain physician’s name (c) information you provide us when you contact us for help, and, (d) information you enter into our system when using the Application, including but not limited to email, phone number, zip code, and third-party wearable data such as, but not limited to, Apple Health/Google Fit.

Automatically Collected Information —
In addition, the Application may collect certain information automatically, such as the type of mobile device you use, your mobile device’s unique device ID, the IP address of your mobile device, your mobile operating system, the type of mobile Internet browsers you use, and information about the way you use the Application.

We may also obtain information about you from other sources such as, but not limited to, other BSC services. This information may be linked to the information collected through the Application (“Information”).

Uses of Information

We use the Information described above to provide you with the services you request, to measure performance of the Application and to develop and improve Application features and associated services, to create records (including records of your Information), conduct data analytics to learn more about your usage of the Application and BSC services and identify opportunities for BSC products and services as they pertain to your health care, and to communicate offers, surveys, and information regarding the Application and BSC products and services. We may also deidentify and/or aggregate the Information. Uses of deidentified and aggregated Information will be in accordance with applicable law and regulation.

What are my opt out rights?

Opt out of all User Provided and Automatically Collected Information collection by uninstalling the Application —
You can stop all collection of information by the Application easily by uninstalling the Application. You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.

Data Retention Policy, Managing Your Information

We will retain Information collected by the Application for as long as you use the Application and for a reasonable time thereafter. If you’d like us to delete Information collected via the Application, please contact us at GlobalPrivacy@bsci.com with a reference to the Application and we will respond in a reasonable time. Please note that some or all of the information collected may be required in order for the Application to function properly, and we may be required to retain certain Information by law.

California Privacy Rights & Do Not Track Disclosures

The Boston Scientific Privacy Notice for California Residents provides additional information for California residents under the California Consumer Privacy Act of 2018 (CCPA), found in Appendix 1.

Please be aware BSC does not respond to your browser’s Do Not Track signals.

Children

We do not use the Application to solicit data from children under the age of 13. If a parent or guardian becomes aware that his or her child has provided us with information without their consent, he or she should contact us at GlobalPrivacy@BSCI.com. We will delete such information from our files within a reasonable time.

Security

BSC is concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain. For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Application. Please be aware that, although we endeavor to provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.

Changes

This Privacy Notice may be updated from time to time for any reason. In the event of a material change, we will notify you in the Application of the changes giving you the ability to accept or decline such changes. For non-material changes, your continued use of the Application confirms your acceptance of the updated Privacy Notice. You are advised to consult this Privacy Notice regularly for any changes.

Your Consent

By using the Application, you are consenting to our processing of Information as set forth in this Privacy Notice now and as amended by us. "Processing” means using cookies on a computer/hand held device or using or touching information in any way, including, but not limited to, collecting, storing, deleting, using, combining and disclosing information, all of which activities will take place in the United States.

This Privacy Notice for California Residents supplements the information contained in Boston Scientific’s Privacy Policy and applies solely to all visitors, users, and others who reside in the State of California (”consumers” or “you”). We adopt this notice to comply with the California Consumer Privacy Act of 2018 (CCPA) and any terms defined in the CCPA have the same meaning when used in this notice.

Information We Collect

Our Application collects information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device ("personal information"). In particular, Boston Scientific’s Application has collected the following categories of personal information from its consumers within the last twelve (12) months:

Your Rights and Choices

Access to Specific Information

You have the right to request that Boston Scientific disclose certain information to you about our collection and use of your personal information over the past 12 months. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will disclose to you:

Deletion Request Rights

You have the right to request that Boston Scientific delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request (see Exercising Access, Data Portability, and Deletion Rights), we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

Response Timing and Format

Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Boston Scientific reserves the right to amend this privacy notice at our discretion and at any time. When we make changes to this privacy notice, we will post the updated notice on the Application and update the notice's effective date. Your continued use of our Application following the posting of changes constitutes your acceptance of such changes.
